Mr. Sudip Ghosh Chowdhury ...for the petitioner Mr. Bidyut Roy Mr. Pratick Bose ...for the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Section 21 (c ) of the NDPS Act. Let a copy of this application be served upon Mr. Bidyut Roy and Mr. Pratick Bose, learned advocates, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since his date of arrest i.e. 12.09.2019. Although the FIR was lodged in September, 2019 and a charge sheet was submitted in March 2019, till date the proceeding could not be concluded. There are seven prosecution witnesses as mentioned in the charge sheet. 05.04.2021 is the date fixed for consideration of charges.

Learned counsel appearing on behalf of the State

submits that it would be in the interest of justice if the impugned proceeding is expedited.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It appears that some delay was occasioned in conclusion of the proceeding, especially as the petitioner is in custody since 12.09.2019.

In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and in particular, to decide the question of framing of charges on the next date of hearing or within 15 days therefrom. With these observations, the revisional application is disposed of.
