For the State The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Canning Police Station Case No. 144 of 2017 under Sections 363/366/372/376/120B of the Indian Penal Code. A plea has been taken that another co-accused person has been enlarged on bail and, therefore, the petitioner, who stands on the same footing, should also be released on bail. The State opposes the prayer for bail.
After hearing the respective submissions and on perusal of the statement of the minor victim girl recorded under Section 164 of the Code of Criminal Procedure, we do not think that the role of the petitioner attributable to the commission of offence can be ruled out at this stage.
The application for bail, being CRM 2809 of 2021, is thus rejected.
