07.06.2021 suman Ct. 19 CRM 1786 of 2015 (Via Video Conference) In Re: an application under Section 439(2) of the Code of Criminal Procedure, 1973.

And In the matter of: Sk. Selim ....Petitioner Mr. Prasun Kumar Dutta, Addl. P.P.

Mr. S. Deb Roy ..for the State None appears on behalf of the petitioner.

Nobody represents the State when the matter is called on for hearing.

Since Mr. Prasun Kumar Dutta, learned Additional P. P. is present in the Court, he is requested by this Court to appear in this matter to which he has agreed. The instant application for cancellation of bail in connection with Uluberia Police Station Case No. 96 dated 07.02.2015 under Sections 354/379/341/506/427 of the Indian Penal Code was registered on 25.02.2015. Subsequently, the petitioner did not take any action for cancellation of bail of the opposite parties. In the meantime, almost six years have elapsed.

Considering the conduct of the petitioner this Court is of the view that the petitioner is not willing to press the instant application.

Accordingly, the application being CRM 1786 of 2015 is dismissed for non-prosecution.
