Petitioner submits that in spite of a decree passed in favour of the petitioner in Partition Suit No. 143 of 2012, the respondents are trying to encroach upon the property of the petitioner and disturbing his peaceful possession. To that effect, the police authorities were informed but they did not take appropriate action.

Learned advocate for the private respondent no. 7 submits that till date the Partition Commissioner has not conducted the commission.

Learned advocate for the State submits that the police authorities on receipt of information has taken effective steps and drawn up proceedings under Section 107 of the Code of Criminal Procedure.

Having regard to the fact that Civil Court is in seisin of the matter. I direct that the police authorities would keep a strict vigil and ensure that no breach of peace takes place between the parties.

With the aforesaid observations, the instant writ petition being WPA 7565 of 2024 is disposed of. Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
