Learned counsel for the petitioner contends that despite the petitioner having deposited the quotation amount for the purpose of installation of a service pole and cable connection instead of the present contraption, made of a bamboo stick, for the purpose of electrification of the petitioner's premises, the Distribution Licensee has not done any work in that regard as yet.

Learned counsel for the WBSEDCL submits that in view of the cultivation going on in the nearby paddy fields, such work has been protracted.

Such contention is controverted by learned counsel for the petitioner, who submits that the harvesting for the last season is over in the area.

It is further submitted by learned counsel for the petitioner that there is an alternative pathway for

installation of such pole and giving the connection to the petitioner.

Be that as it may, since the petitioner has already deposited the quotation amount, subject to compliance of all further formalities by the petitioner, if any, there cannot be any impediment to the WBSEDCL to construct a proper electricity pole and give a cable connection to the petitioner, in order to avoid the risk of accident and electrical hazard.

In such view of the matter, WPA 6641 of 2022 is disposed of by directing the WBSEDCL to hold a joint inspection for the purpose of ascertaining the proposed route of the suggested electricity pole with the petitioner and other persons concerned and, subject to production of a 'Way Leave Certificate' by the petitioner and compliance of any other formalities, if necessary, by the petitioner, to undertake such work of installation of a pole and giving a cable connection, subject to feasibility, as early as possible.

It is expected that the entire exercise shall be concluded within a month from date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
