Mr. Binoy Kumar Panda, learned advocate, and Mr. Pravas Bhattacharya, learned advocate, who usually appear on behalf of the State, are present in Court. They are requested to appear on behalf of the State in this matter. Their appointment may be regularized by the concerned authority.
Learned lawyer on behalf of the State appears and submits that the case is pending since 2011. No steps have been taken on behalf of the petitioner to proceed with this revisional application. It is further submitted that no stay was granted after 08-02-2012.
After careful perusal of the impugned order, it is found that on behalf of the prosecution, one application was made before the learned Additional Sessions Judge, 1st Fast Track Court, Rampurhat, Birbhum with a prayer to call for the Injury Register dated 16-04-2008 of the injured Lalu @ Lalchand from the Murarai Hospital and it was prayed that the Investigating Officer failed to collect the said injury report. Learned Judge did not allow that application as no copy of the injury report was placed before the learned Judge at the relevant point of time. So, the learned Judge also disallowed the prayer for examination of the doctor to that effect.
After careful perusal of the order impugned, I do not find any illegality or irregularity to interfere in exercising revisional jurisdiction. Thus, the revisional application stands dismissed along with the connected application. Let a copy of this order be communicated to learned Additional Sessions Judge, 1st Fast Track Court, Rampurhat, Birbhum through the learned Registrar, Judicial Service, of this Court.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of all necessary formalities.
