The petitioner is the legally married wife of the opposite party. She filed an application under Section 12 read with Sections 18 and 23 of the Protection of Women from Domestic Violence Act, 2005 which is now pending before the learned Judicial Magistrate, 3rd Court at Howrah.

It is the grievance of the petitioner that though the statutory requirement is that an application for interim monetary allowance

shall be disposed of within one month from the date of filing, the learned Magistrate failed to dispose of even an application for interim monetary allowance till date.

The learned Magistrate, 3rd Court, Howrah is directed to dispose of the application for interim monetary allowance filed by the petitioner positively by the next date fixed. With the above order, the instant revision is disposed of. The petitioner is at liberty to act on the server copy of the order.
