IN THE HIGH COURT AT CALCUTTA

CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE WPA 6655 of 2022 Subrata Kumar Dutta Vs.

Indian Bank & Ors.

Ms. Prisanka Ganguly .... For the petitioner.

Mr. Om Narayan Rai, Mr. Saikat Roy Chowdhury ... For Indian Bank.

The petitioner while in service at Allahabad Bank, now known as Indian Bank after the merger, was subjected to a disciplinary proceeding. The disciplinary proceedings ended with an order dated 25th January, 2019. By the said order the pay of the petitioner was brought down to lower stage in the scale of pay by two stages.

The petitioner preferred appeal on 9th April, 2019 challenging the said order. The appeal is still pending, although the applicable rules provide for a time-bound disposal of the same. The petitioner says that in the meantime, while the appeal was pending, the petitioner has retired from the services in May, 2020. The petitioner prays for expeditious disposal of the appeal. Considering the petitioner's submission, I direct the present Appellate Authority of Indian Bank to dispose of

the petitioner's appeal filed on 9th April, 2019, as expeditiously as possible, but not beyond three months from the date of communication of a server copy of this order. The Appellate Authority shall follow the rules and adhere to the principles of natural justice while disposing of the appeal.

All parties, including the Appellate Authority, shall act on the basis of the server copy of this order, duly downloaded from the official website of this Court, without insisting upon production of certified copy thereof. Since the Bank is represented, no further notice is required to be given to the Bank.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegation made in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
