Petitioner filed this revisional application praying for quashing of proceedings in connection with Domjur Police Station Case No.521/10 giving rise to G.R. Case No. 4216 of 2010 under Section 4D of the West Bengal Land Reforms Act, pending before the Learned Chief Judicial Magistrate, Howrah.
On a perusal of the Case Diary it appears that the complaint was lodged by the Block Land & Land Reforms Officer to the I.C., Domjur Police Station informing that low "Sali" land comprised in R.S. Plot No.5861, 5863, 5864, 5867 and 5868 of Mouza - Domjur had been filled up without obtaining any permission from the competent authority,
thereby violating Section 4C of the W.B.L.R. Act, 1955. I find material in the Case Diary indicating that the land belongs to Balaram Srimani @ Balaram Sreemany, the petitioner herein has been filled up. Under such circumstances, the revisional application is dismissed on merit.
Interim order, if any, stands vacated.
Case Diary be returned to the learned advocate for the State. Let a copy of this order be communicated the Learned Chief Judicial Magistrate, Howrah for information.
