Das Ms. Indrani Nandi ... for the State Mr. Suman Basu ... for the respondent no.2 The petitioner is an unmarried daughter of late Gouri Charan Banerjee, who was an Assistant Teacher under the D.P.S.C., Purulia. The petitioner's father received pension until he died on 6th February, 1992. The petitioner applied for family pension as an unmarried daughter of the late Gouri Charan Banerjee which is stated to have been rejected by the State. Since the right of an unmarried daughter to pension on account of her father's service upheld in MAT 1518 of 2019 delivered on 20.06.2023, the petitioner is entitled to pension. Thereafter the State of West Bengal approached before the Hon'ble Supreme Court and filed SLP being diary No(s).30809 of 2024. The SLP has been dismissed on 12.12.2024. The office of the Accountant General (A & E) West Bengal issued a

letter on 23.07.2025 and requested to compliance of the order of the Hon'ble Court.

In those circumstances, the DPPG shall issue Pension Payment Order within one month from the date of receipt of a copy of this order to the petitioner and pay her arrears from the next date of death of her father till date together with interest @ 8% per cent annum. Arrears be paid along with interest within one month thereafter.

The order dated 16th June, 2015 denying the pension of the unmarried daughter is set aside. With the aforesaid directions, the instant writ petition shall stand disposed of.

There shall be no order as to costs.
