It appears that another co-accused in the present case, namely Subham Singh, was granted bail by the Hon'ble Supreme Court vide its order dated 22 May 2026. The relevant extract of the said order is reproduced below:

"Though the appeal is opposed by the learned Solicitor General and the learned counsel appearing for the complainant, the fact remains that charges are yet to be framed and that witnesses are yet to be examined. We are dealing with a case of cross-FIRs. There is also a pending civil suit inter se the parties. Considering the above, we are inclined to set aside the impugned order and grant bail to the appellant.

Accordingly, the impugned order stands set aside and the appellant is granted bail on terms and conditions to the satisfaction of the concerned Trial Court."

Although interim bail was granted to the petitioner to enable him to contest the West Bengal Legislative Assembly Election, 2026, in light of the observations made by the Hon'ble Supreme Court in respect of another accused in the same case, this Court is of the considered view that the interim bail granted to the petitioner deserves to be confirmed.

The conditions of bail are, however, modified as follows: (i) The petitioner shall remain present before the learned Trial Court on each and every date fixed for the trial. (ii) In the event the petitioner remains absent on any date without sufficient and justifiable cause, the learned Trial Court shall be at liberty to cancel the bail granted to him without making any further reference to this Court.

Accordingly, CRM (M) 776 of 2026 along with CRAN 1 of 2026 is disposed of.
