Learned advocate for the petitioners submits that the impugned order dated April 5, 2022 passed by the Sub-Divisional Officer & Prescribed Authority & SubDivisional Magistrate, Baruipur, South 24 Parganas under Section 11(1)(d) of the West Bengal Panchayat Act, 1973 is an appealable one.

Leave has been sought for withdrawal of the writ petition and for filing the appeal before the appellate authority.

Leave sought for by the petitioners is granted. Accordingly, the present writ petition stands withdrawn with leave to the petitioners to approach the

appellate forum for redressal of their grievances, in accordance with law, if so advised.

The petitioners will be entitled to apply before the appellate authority praying for condoning the delay in filing the appeal in view of the pendency of the writ petition before this Court.

Affidavit-of-service filed in Court today is taken on record.
