Mr. Jaydip Basu Mr. Kaustav Chatterjee ....Advocates This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 7th Court at Howrah to dispose of Title Suit no.202 of 2025 expeditiously.

The learned advocate appearing for the petitioner submits that hearing of the applications under Order XXXIX Rule 1 and 2 and Order XXVI Rule 9 read with Section 151 of the Code of Civil Procedure, 1908 are pending and tomorrow, i.e., 28th March, 2025 is the date fixed for hearing of the said applications. In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record for the petitioner shall be obliged to forward a copy of

this application along with this order upon the opposite parties or upon the learned advocate representing the opposite parties before the learned Trial Judge.

In view of the submissions made by the learned advocate appearing for the petitioner, CO 1101 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 7th Court at Howrah to take up the hearing of the pending applications and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
