Learned counsel for the petitioner submits that during pendency of the writ petition the Sub-Divisional Magistrate has passed an order in terms of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962 for eviction of the private respondent from the property in question. This order has been appealed by the private respondent. The same is pending.

Learned Additional Government Pleader represents the State.

In view of the fact that an appeal has been preferred by the private respondent against the order of the learned Sub-Divisional Magistrate, no further order need be passed.

Let the appeal be decided in accordance with law and expeditiously.

With these observations, the writ petition is disposed of without any further order, even as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
