1. The petitioners are aggrieved that the West Bengal Board of Primary Education in violation of the order dated 1st March, 2023 in W.P.A. No. 24562 of 2022 has included in the merit list and or has issued letters of appointment to in-service candidates in the recruitment process, pursuant to the Notification dated 29th September, 2022.

2. Counsel for the Board vehemently opposes the submissions of the learned Counsel for the petitioners. He submits on instructions from his clients that not a single in service candidate has either been included in the merit list or issued any letter of recommendation. The question of any appointment, therefore, does not and cannot arise at all.

3. In view of the submissions of the WBBPE aforesaid, the instant writ petition shall stand disposed of.

4. There will be no order as to costs.

5. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
