Ms. Jayashree Patra Ms. Pritha Sinha Mr. Nabendu Krishna Ghosh Ms. Olivia Dutta ... for the Petitioner(s) Mr. Joydeep Biswas Mr. Parvej Anam ... for the State-respondent(s) Learned advocate for the petitioner submits that inspite of the earlier directions passed on 10.11.2025 in CRM (M) 1789 of 2025, till date, charges have not been framed. The prosecution in the charge-sheet has only relied upon 7 witnesses in order to prove its case. According to the learned advocate, the petitioner was arrested in January, 2025 and since then she is in custody, as such, he prays that the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail.

Having taken into account the period of detention of the present petitioner and the fact that there is no possibility

of the trial being taken to its logical conclusion within the fixed period, I am of the view that further detention of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Rinku Sarkar @ Biswas shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Bongaon, North 24 Parganas.

If on bail, the petitioner shall also make herself physically available on each and every date so fixed by the learned trial court and shall not leave the district of 24 Parganas, North without prior intimation to the learned trial court.

The petitioner shall furnish her address to the learned trial court as well as Petrapole Police Station. The Inspector-in-charge of said police station would be at liberty to visit the said address, cross-check and submit a report before the learned trial court regarding the availability of the present petitioner.

Accordingly, CRM (M) 780 of 2026 is allowed.

Pending application(s), if any, is also disposed of.
