AAG, Ms. Ashima Das (Sil) ....for the Alleged Contemnor Pursuant to the order dated 14th November, 2025, the Superintendent of Police, Baruipur Police District has considered the representation and has passed an order, which has been duly communicated to the contempt applicant/petitioner.

The principal grievance in this contempt application is that the representation was not considered even after lapse of a long period of time that was granted to consider the same by the order dated 7th August, 2024.

This Court, by an order dated 14th November, 2025 after noticing the conduct of the concerned Superintendent of Police, Baruipur Police District, had

clearly expressed the same to have not been appreciated by this Court.

However, time was given to the concerned Superintendent of Police, Baruipur Police District to dispose of such representation without formally condoning the delay. As per the contempt application, Mr. Palash Chandra Dhali was the Superintendent of Police of Baruipur Police District when the order dated 7th August, 2024 was passed.

It was incumbent upon the said Palash Chandra Dhali to dispose of the representation of the contempt applicant/petitioner as per the direction of this Court. From the report of compliance, it appears that the order has been passed by the said Palash Chandra Dhali on 27th November, 2025 immediately before he was transferred to Paschim Medinipur. The delay in carrying out the directions given by the order does not absolve the said Mr. Palash Chandra Dhali from having not complied with the order even though it has been ultimately complied with. The mandate was disposal within a time frame and not disposal at his whims. Mr. Palash Chandra Dhali is put on caution so that in future the said Mr. Palsh Chandra Dhali adheres to any direction given by this Court.

Nothing further remains to be adjudicated in this contempt application, as the petitioner has to take

different course, as may be advised, if he is dissatisfied with the reasoned order passed on 27th November, 2025. The contempt proceedings is dropped and the contempt application being CPAN 510 of 2025 is accordingly disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
