Mr. Srikanta Dutta Mr. Sk. Ainuddin Ahammad ... for the petitioner Mr. S. S. Koley ... for the WBSEDCL The petitioner seeks restoration of an electricity connection and consequential directions for refund of excess amount allegedly paid by him to WBSEDCL.
On behalf of WBSEDCL, it is submitted that the instant writ petition is an abuse of process. The petitioner is a habitual defaulter and there are outstanding dues in excess of approximately Rs.10,00,000/- inclusive of Late Payment Surcharge, which remain unpaid till date.
Upon consideration of the submissions, it appears that the petitioner had filed an earlier writ petition being WPA 9260 of 2015. By an order dated 12 May, 2015, the petitioner was directed to pay the outstanding dues in twenty equal installments. Instead of making payment in terms of order dated 12 May, 2015 the petitioner had chosen to file a complaint before the Consumer Redressal Forum being CC No. 281 of 2015,
which was ultimately dismissed with costs assessed Rs.10,000/-. Thereafter, the petitioner made a representation dated 9 March, 2017 and a further representation dated 8 September, 2017 when the petitioner was permitted to make payment in installments which he also failed to do.
The facts of the case reveal that the petitioner is not only a habitual defaulter but is also procrastinating payment on frivolous pretexts. There is no enforceable legal right which the petitioner can claim in this writ petition. There are no grounds to exercise any discretion in favour of the petitioner. The petitioner is only interested in delaying payment and there are no grounds warranting interference by the Writ Court.
In view of the above, there is no merit in the writ petition.
WPA 7149 of 2026 stands dismissed.
There shall, however, be no order as to costs.
