APP, Mr. Dipankar Paramanick, ...for the State The petitioner was arrested in connection with another case, namely Kasba Police Station Case No. 499/25 dated October 25, 2025, registered under Sections 3(5), 61(2), 329(2), 124(1), 124(2), 311, and 109(2), read with Sections 25 and 27 of the Arms Act and Section 111 of the BNS.

After more than three months from his physical arrest, the petitioner was shown as arrested in the present case following a suo motu F.I.R. on January 13, 2026. The

procedural formalities in respect of such arrest, however, appear to have been duly complied with, as the petitioner was produced physically before the learned Chief Judicial Magistrate, Alipore, on the same date.

It appears that the petitioner was shown to have been arrested in the present case on the basis of the statement of a co-accused.

Mr. Rajdeep Mazumder, learned Senior Advocate appearing for the petitioner, submits that the co-accused has already been granted bail on February 3, 2026. Learned counsel appearing for the State has strongly opposed the prayer for bail, submitting that the petitioner has extensive criminal antecedents. It is further submitted that a total of eleven firearms were recovered pursuant to the statement of the co-accused.

It is not in dispute that the petitioner has remained in custody in connection with Kasba Police Station Case No. 499/25 to date and has not yet been released on bail. Having regard to the nature of the offence and the fact that the recovery was made more than three months after the petitioner's arrest, while he was in custody, this Court is of the view that further detention in connection with the present case is not necessary.

Accordingly, this Court is inclined to grant bail to the petitioner.

The petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of the like amount each, one of whom must be a local, to the satisfaction of the learned Chief Judicial Magistrate, Alipore, South 24 Parganas.

It is further directed that the petitioner shall appear before the Investigating Officer as and when required. Failure on the part of the petitioner to comply with the aforesaid conditions shall entitle the trial Court to cancel the bail granted to the petitioner in accordance with law, without any further reference to this Court.

Accordingly, CRM (M) 777 of 2026 stands allowed. (Kausik Chanda, J.)
