Mr. Sakti Pada Jana Mr. Subhajyoti Das ...for the petitioner Mr. Pantu Deb Roy Mr. Subrata Guha Biswas ...for the State The petitioner has filed the present writ petition challenging the inaction on the part of the respondent R.T.A., Bankura, in considering his representation dated "NIL".

The petitioner's prayer is for extension of the permitted route on which the petitioner operates his vehicle i.e. from Molian to Bankura. The petitioner wanted the said route to be extended from "Molian to Guniada" and with regard to the same, the petitioner has filed his said application before the concerned authority. According to the petitioner, the same has not yet been considered and no opportunity of hearing has been offered to him, by the said respondent authority.

Mr. Deb Roy is representing the State through virtual mode. He has stated that necessary order may be passed directing the respondent authority to consider the petitioner's representation as above.

Having heard the learned counsels and having perused the documents on record, it is found that the petitioner's vehicle No. WB 33D/5432 is operating on the route from "Molian to Bankura" which is No. PSTP WB 2024-SC-0415A. The petitioner is not financially benefited from plying the vehicle through the said route, which extends up to 36 km. Thus, the petitioner has proposed the route of a length of 54 km, so that he can pursue a profitable operation over there. The proposed route is as mentioned above. To that effect, the petitioner's representation has been filed before the Secretary, RTA, Bankura and the same is now pending.

Let the said respondent i.e. Secretary, RTA Bankura, consider and dispose of the petitioner's prayer as above, vide his representation dated February 11, 2025.

The petitioner and any other stake holder having interest, shall be given opportunity of hearing and the said respondent authority shall pass a reasoned order within a period of 4 weeks from due date of communication of copy of this order, if not, the prayer of the petitioner be allowed by it immediately. The order of the respondent as above, shall be communicated to the petitioner, within one week from its date.

The writ petition is disposed of.

Since no affidavit has been called for, allegations made in the writ petition are deemed to have been not admitted by the respondent.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
