The first writ petition in the series, i.e. WPA 5800 of 2011 has already been dismissed for default on January 10, 2024. Hence, Ms. Shetparna Roy, learned advocate led by Mr. B.N. Ray, learned Senior counsel being the petitioner in WPA 13385 of 2011 proceeds for the petitioner.

Ms. Shetparna Roy, learned counsel appearing for the petitioner has made her submissions extensively. She shall continue with her submissions specifically on the point of maintainability of the writ petition, whether a candidate merely being empanelled has a right to claim recruitment.

Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader, appears for the respondent nos. 1 to 3.

On the prayer of learned counsel for the petitioner, the writ petition shall appear under the heading "For Orders" on February 6, 2024.
