Inadvertent error has crept into the order passed on 22nd May, 2025.
In the cause title of the order the names of Iqbal Kabir and Dipankar Mahata be recorded in place and stead of Mr. Binoy Kumar Panda and Debarshi Brahma as learned counsels appearing for the State.
The department is directed to incorporate correction accordingly.
This order be treated as part of the order passed on 22nd May, 2025.
The petitioner is in custody for more than two years and prays for bail.
Learned counsel for the petitioner submits that out of four accused three are on bail. Only four out of 59 witnesses have been examined so far.
Learned counsel for the State opposes the prayer and submits that the State proposes to examine another thirty witnesses and shall conclude the trial within one and half years/two years. I have perused the material on record.
The bail prayer of the petitioner was rejected earlier considering the material on record. The petitioner appears to be the principal assailant who was last seen together with the victim prior to the incident.
Considering the incriminating material against the petitioner and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.
It is pertinent to mention that co-accused on bail are not similarly circumstanced with the petitioner.
The learned trial Court is directed to expedite the trial and conclude the said at an early date in the light of the submission made on behalf of the State.
The application for bail is disposed of.
