Ziaur Rahaman ... for the State-respondent(s) Mr. Gautam Chakraborty ... for the private respondent no.5 The petitioner is aggrieved as a direction was passed by the learned Judicial Magistrate, 2nd Court, Rampurhat, Birbhum upon the Officer-in-charge of Beniapukur Police Station to conduct an enquiry under Section 202(1) of Cr.P.C.
Such order was passed on 31st August, 2024 and next date was fixed on 11.11.2024.
According to the petitioner, till date, no such report has been submitted and, to that effect, reminder had been issued by the learned Magistrate.
State has submitted a report
which reflects that the entire incident took place within the jurisdiction of Rampurhat Police Station, Birbhum, which comes under the jurisdiction of different police station. As such, Beniapukur Police Station is facing inconveniences.
Be that as it may, since a report was called for from the learned Judicial Magistrate, whatever inconveniences and/or issues relating to facts or law are concerned, Beniapurkur Police Station must send a report on the next date so fixed.
It is reiterated that if the merits of the issues complained of do not fall within the jurisdiction of the said police station which has been referred to therein, in that case, the police authorities at least would send such intimation in the form of a report as called for by the learned JM, 2nd Court, Rampurhat, Birbhum in connection with CR Case No. 293 of 2024.
The Officer-in-charge of the concerned police station would ensure that
such report is filed before the concerned court on the next date so fixed.
With the aforesaid observations, WPA 7013 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Report so submitted be kept with the record.
