It appears from the report that the petitioner's vehicle negligently colluded with the lorry and no evidence could be gathered against the driver of the lorry. Notice under Section 91 of the Code of Criminal Procedure was served on the petitioner, but he sought time to appear before the police authority.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the police authority is holding an enquiry into the matter, the authority shall hold such enquiry and take necessary steps in accordance with law. The petitioner shall cooperate with the police authority in holding such enquiry. No fruitful purpose shall be served by keeping the writ petition pending and the same is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
