IN THE HIGH COURT AT CALCUTTA

CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE WPA 6689 of 2022 Gyandev Kumar Vs.

Union of India & Ors.

Mr. Malay Bhattacharyya, Ms. Shefa Mondal .... For the petitioner.

Ms. Susmita Saha Dutta ... For the respondents.

Affidavit of service filed in Court today is taken on record.

The petitioner participated in the selection process for recruitment of Constable General Duty in CAPFs, NIA & SSA & Rifleman General Duty in Assam Rifles conducted by Staff Selection Commission (in short, SSC), in terms of an advertisement published in the year 2018. The petitioner's name on being successful was included in the merit list published by SSC. The petitioner says that although the petitioner's name was recommended for appointment but no appointment has been given till date. The petitioner says that in answer to the queries made under Right to Information Act, 2005, the petitioner has been informed that the verification of the dossiers are pending. The petitioner says that in respect of most of the successful candidates, the appointment has been given. Due to delay in giving the appointment, the petitioner is

losing seniority.

After hearing the parties and considering the materials on record, I direct the respondent no.6, to take a final decision in respect of the petitioner and provide the petitioner appointment, if he is otherwise found eligible since his name has already been included in the merit list on being successful in the selection process. The entire exercise should be completed within a period of two months from date.

All parties, including the respondent no.6 shall act on the server copy of this order duly downloaded from the official website of this Court, without insisting upon production of certified copy thereof.

Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegation made in the writ petition are deemed to have not been admitted by the respondents.

Urgent photostant certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
