In pursuance of the direction passed by this Court, a report is submitted by the Superintendent of Police, Purba Medinipur.

It is stated in the report that the sole appellant/convict, Harendra Nath Maity, has been expired during the pendency of this appeal on 13.6.2017. A photocopy of certificate of death, as submitted by the concerned police station, also affirms the death of the appellant/Harendra Nath Maity.

As the sole appellant died, the instant appeal stands abated against him.

Accordingly, the instant appeal being CRA 119 of 1998 is hereby dismissed as abated.
