The learned Counsel for the appellant submits that the suit has substantially progressed and as on date this appeal may have become infructuous. Accordingly, he has prayed for withdrawal of the appeal.

In view of the aforesaid submission, the appeal being FMA 1263 of 2017 and the connected application CAN 1 of 2017 (Old No: CAN 2484 of 2017) stand dismissed as withdrawn.

However, we request the learned 2nd Civil Judge (Senior Division) at Alipore to expedite the hearing of the suit and conclude the proceeding preferably within a period of one year from the date of communication of this order without granting any adjournment to either of the parties unless it becomes unavoidable.
