Mr. Abu Siddiqui Mallik ... for the State-respondent(s) The petitioner is aggrieved by the fact that he is trying to construct his boundary wall which is being resisted by the private respondent who happens to be a promoter. The petitioner complains that he has been threatened with dire consequences and, to that effect, an information was furnished to the police authorities but the police authorities refused to take any action.

Having considered that so far as the issue relating to raising and/or construction of a boundary wall is concerned - demarcation of the property is required and, establishment of a boundary

wall may be a point of dispute. As such, until and unless there is a direction upon the police authorities, the police authorities will not act or interfere in such circumstances.

However, if there is any problem being faced by the petitioner after obtaining the valid sanction plan, the petitioner if so advised, would approach the appropriate authorities and/or the learned civil court.

In the meantime, the police authorities would ensure that no breach of the peace and/or tranquility taking place as also no untoward incident resulting because of the strained relationship existing between the parties because of such construction proposed to be made by the petitioner.

With the aforesaid observations, WPA 7034 of 2025 is disposed of.
