22.05.2025 Item No.26 Ct.No.34 rc.
C.R.M. (DB) 1106 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Beldanga Police Station Case No. 573 of 2024 dated 31.07.2024. And In Re :
Sadikur Rahaman ... Petitioner.
Mr. A. Chatterjee Mr. Avik Ghosh Ms. D. Biswas Ms. Poulami Bose ... for the Petitioner Mr. Manas Kumar Das Mr. Mohaidur Hossain ... for the Defacto Complainant The petitioner is in custody for about ten months and prays for bail.
Learned counsel for the petitioner submits that the victim committed suicide by consuming poison and the petitioner took her to the hospital after the incident. He has been falsely implicated. No charge has been framed under Section 328 of the Indian Penal Code. He prays for bail. Learned counsels for the State and defacto complainant oppose the prayer.
Heard learned counsels for the parties.
I have considered the material on record. The petitioner appears to be the husband of the hapless victim who died within seven months of her marriage. Considering
the gravity of the offence and prima facie involvement of the petitioner therein prayer for bail is rejected at this stage. The application is disposed of.
Case Diary be returned.
