Banerjee) Mr. Mrinal Kanti Ghosh Mr. Kuntal Banerjee ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the mother and natural guardian of minors praying for a direction upon the learned District Judge, 24 Parganas North at Barasat to dispose of miscellaneous case under Section 8(2) of the Hindu Minority and Guardianship Act, 1956 read with Section 29 of the Guardian and Wards Act, 1890 expeditiously.

Mr. Ghosh learned advocate for the petitioner submits that all formalities as directed by the learned District Judge, have been completed and February 17, 2025 was fixed for hearing of the miscellaneous case. He further submits that the next date for hearing of the said miscellaneous case has been fixed on July 7, 2025.

Considering the nature of the miscellaneous case, this court is of the considered view that the same should be disposed of expeditiously.

In the light of the submissions made by the learned advocate for the petitioner, CO 1110 of 2025 is disposed of by requesting the learned District Judge, North 24 Parganas at Barasat to take up the hearing of the Act VIII Miscellaneous Case no. 149 of 2024 if the same is otherwise ready for hearing on the next date, i.e., July 7, 2025 and to make an endeavour to see that the same is disposed of the same as expeditiously as possible, preferably by the end of September, 2025, without granting any unnecessary adjournment to either of the parties.
