The private respondents are not represented despite service.

The petitioner claims to have purchased the plot in question by virtue of a registered deed of sale and is running a business therein. He alleges that the private respondents, in connivance with the police authority, have raised bamboo fencing by encroaching upon his land, thereby obstructing smooth running of his business. The petitioner filed written complaint before the Sub-Divisional Officer, Inspector in charge, Ranaghat Police Station and Superintendent of Police, Ranaghat Police District but to no effect.

Learned counsel for the State submits that the civil suits are pending between the parties and the dispute being essentially civil in nature, shall be dealt with by the learned civil Court.

It appears that the civil suits are pending between the parties and this Court is informed that the petitioner is

enjoying an ad-interim order of injunction granted by the learned civil Court. The dispute between the parties is civil in nature. Petitioner has his remedy before the learned civil Court.

Also, the petitioner complains that the complaints lodged by him have not been taken care of by the police authority. In that event also, the petitioner is at liberty to take necessary steps before the jurisdictional Magistrate for redressal of his grievance.

With the aforesaid observation and directions, the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
