The petitioner's application tendering resignation from the post of Assistant Engineer (Civil) of the West Bengal Essential Commodities Supply Corporation Limited submitted on July 7, 2025 is alleged to be kept pending before the respondent authority till date. Three-month is the notice period for tendering resignation. The said period is long over.

Prayer has been made to direct the concerned authority to dispose of the petitioner's application tendering resignation.

Learned counsel for the respondents admits that the notice period for consideration of the prayer of the petitioner tendering resignation is over. 4.
It appears that the petitioner has already participated in the recruitment process in the Kolkata Municipal Corporation and he has been shortlisted for appointment for the post of Assistant Engineer (Civil). There is every possibility that he may be issued an appointment
letter within a short period. Without the acceptance of resignation, the petitioner will not be in a position to join his new service.

In view of the above, the instant writ petition stands disposed of by directing the General Manager (Personnel), West Bengal Essential Commodities Supply Corporation Limited, the third respondent herein, to decide the petitioner's application tendering resignation strictly in accordance with law at the earliest but positively within a period of three weeks from the date of communication of this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
