(DB) No. 1111 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Taherpur Police Station Case No. 171 of 2021 dated 14.07.2021 under Sections 498A/307/34 and added Sections 304B/302 of the Indian Penal Code.

And In Re : Raju Majhi alias Maji ..... petitioner Ms. Minoti Gomes Mr. Partha Sarathi Das Ms. Shanta Sarkar ... for the petitioner Mr. S. G. Mukherjee, learned PP Ms. Faria Hossain Mr. Anand Keshri ... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Petitioner is the husband of the victim lady. She made dying declaration implicating the petitioner. Bail prayer of the petitioner was rejected earlier on merits. Hence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Learned Magistrate is directed to commit the case to the Sessions Court at the earliest. Learned trial Judge will proceed with utmost expedition and ensure the examination of the medical witnesses who recorded the dying declaration with utmost promptitude.

Parties including Officer-in-Charge, Taherpur Police Station shall communicate copy of this order to the learned trial court for necessary compliance.
