1. No one is present on behalf of the appellant nos. 2 and 3.

2. State is represented.

3. In pursuance of the direction passed by this Court a report is submitted by the learned Registrar Administration (L & OM) along with a report submitted by the Superintendent of Police Ranaghat Police District indicating that during the pendency of this appeal, appellant nos. 2 and 3, namely, Shri Tapan Kumar Das and Smt. Sovarani Das were expired. Photocopies of certificate of death of those appellants/convicts are tagged with the report which also affirms the death of the appellant nos. 2 and 3.

4. So, the instant appeal stands abated against the appellants no.(s) 2 and 3.

5. It further appears from the order dated 01.12.2022 that the appellant no. 1 had already expired during the pendency of this appeal and the instant case was abated against him.

6. As all the appellants/convicts have been expired during the pendency of this appeal, the instant case stands abated against them.

7. The instant appeal be and the same is hereby dismissed as abated.

8. Accordingly, the instant appeal being CRA 232 of 1993 is hereby disposed of.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
