Md. Shajada @ Rohit v. State Of West Bengal
22.05.2025 Item No.32 Ct.No.34 rc.
C.R.M. (DB) 1114 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Belur Police Station Case No. 85 of 2024 dated 19.05.2024. And In Re :
Md. Shajada @ Rohit ... Petitioner.
Ms. Suchismita Chakraborty ... for the Petitioner Ms. Amita Gaur Ms. Chandreyi Dutta ... for the State The petitioner is in custody for a year and prays for bail.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated and has no nexus with the alleged offence.
Learned counsel for the State opposes the prayer and submits that the prosecution proposes to examine 7-8 more witnesses. Ten witnesses have already been examined. I have considered the material on record. The petitioner was seen to enter the place of occurrence soon after the victim on the relevant date.
Considering the gravity of the offence and prima facie involvement of the petitioner therein as well as the fact that there is considerable progress in trial, prayer for bail is rejected at this stage.
The application is disposed of.
Case Diary be returned.
