20.12.2021 sl .19 sk ct.29 Mr. Binoy Kumar Panda along with Mr. Narayan Prasad Agarwal, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Public Prosecutor is requested to regularize the appointment of Mr. Binoy Kumar Panda and Mr. Narayan Prasad Agarwal learned advocates in due course.

Learned Advocate on behalf of the State appears and submits that though initially the proceedings pending before the learned Additional Chief Judicial Magistrate, Alipore, 24-Parganas (South) was stayed by this court for the period of two months by the order dated 8.6.2011 of this court. But unfortunately, thereafter, that stay order was not extended ever on any application on behalf of the petitioner.

This revisional application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure whereby it was prayed for quashing of the Rabindranagar Police Station Case No. 136 of 2009 dated 13.9.2009 under Sections 306/34 of the Indian Penal Code. On careful perusal of the revisional application and annexures thereto, I find that the learned trial court already issued process on 25.9.2010, upon the petitioner.

In this matter I do not find any illegality or irregular in this order. I do not find any reason to interfere with this proceeding pending before the learned Additional Chief Judicial Magistrate, Alipore, 24-Parganas (South).

Thus, the revisional application stands dismissed. The learned Registrar (Judicial Services) is requested to communicate this order to the learned Additional Chief Judicial Magistrate, Alipore, 24-Parganas (South) forthwith. (Bibhas Ranjan De, J. )
