Imran Mallick v. State Of West Bengal
26.08.2021 Item no.17 Ct. No.34 CHC C.R.R. No.938 of 2012 (Physical Hearing) In Re: An application under Sections 397/401 of the Code of Criminal Procedure, 1973 read with Section 482 of the Code of Criminal Procedure.
AND In the matter of:- Imran Mallick ... petitioner Mr. Arijit Ganguly, Mr. Sandip Chakraborty ...for the State Learned advocate appearing for the State submits a report of the Inspector-in-Charge, NSCBI, Airport Police Station. Report reflects that the next date is fixed on 28.12.2021 for supply of copy.
In view of the fact that the petitioner challenged the chargesheet without the documents relied upon by the prosecution under Section 207 of the Code of Criminal Procedure being available to him, I am of the view that the revisional application has been preferred at premature stage. As such, no final opinion can be expressed by this Court on the issues challenged by the petitioner as whole of the case records have not been considered by the petitioner. Hence, no interference is called for.
Accordingly, C.R.R.938 of 2012 is disposed of. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
