Imtiazuddin ....for the Petitioners Ms. Sabnam De Bardhan, Mr. Dhananjay Banerjee ....for the State Despite direction, no report in the form of an affidavit has been filed by the respondents in particular Britannia Engineering Limited (in short, "BEL"). In WPA 7623 of 2024 [Mohan Chand Shaw & Ors. Vs. The State of West Bengal & Ors.], the point of granting the retired employees of BEL, the benefits under 6th Pay Commission was considered in the light of the affidavit filed by the respondents and relegated to the respondent no.4 therein who is also the respondent no.4 in this writ petition for due implementation in accordance with law. Since the same issues are involved in this writ petition and considering the stand taken by BEL and State in the affidavit filed in the other writ petitions, this writ petition is also disposed of on the same line by directing the respondent no.4 to take necessary steps to release

the legitimate dues of the petitioners particularly after computing the gratuity and leave salary on the basis of the enhanced scale of pay under the 6th Pay Commission.

Nothing further remains to be adjudicated in this writ petition. The same is accordingly disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
