Learned counsel for the petitioner, in his usual fairness, submits that the petitioner is ready to pay all dues for the purpose of transfer of the name of the petitioner in place and stead of his deceased father, who was the original consumer of the electricity meter in question.

Learned counsel appearing for the Distribution Licensee submits that previously there were several orders passed by coordinate Benches in other writ petitions in connection with the meter.

Learned counsel for the petitioner clarifies that initially there was an order of giving installments to the petitioner for clearing the payments to the Distribution Licensee.

However, subsequently a contempt petition has been filed alleging disobedience of the order by the Distribution Licensee, which is still pending.

Be that as it may, since the petitioner is now agreeable to pay the entire amount payable to the Distribution Licensee at one go, irrespective of the effect of such payment on the pending contempt matter, there cannot be any further impediment on the issue. Accordingly, WPA 6738 of 2022 is disposed of by granting liberty to the petitioner to deposit the entire outstanding amount, which is submitted to be Rs. 84,847/- on behalf of the Distribution Licensee, within two months from date.

Subject to such payment, the WBSEDCL will effect the transfer in favour of the petitioner, of course, subject to compliance of all other formalities by the petitioner. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
