This revisional application has been filed praying for expeditious disposal of Miscellaneous Appeal No.302 of 2018, pending before the learned Additional District Judge, Fast Track, 4th Court, Alipore.

The petitioner has submitted that several dates have been fixed by the learned court below for hearing of the appeal but the same has not yet been disposed of. Under such circumstances, this Court finds that justice would be sub-served if the learned court below is directed to dispose of the misc. appeal being Miscellaneous Appeal No.302 of 2018 expeditiously, preferably within a period of four months from the next date fixed and in accordance with law. The respective parties should be given an opportunity to contest the proceeding.

This Court has not gone into the merits of the claims and counter-claims of the parties and the learned court below will proceed with the misc. appeal in accordance with law and dispose of the same independently on its own merits.

The petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite parties and/or their learned advocate appearing in the learned court below within this week. The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
