The petitioners' case is that one Sabita Das was initially the teacher-in-charge of the petitionerno.1School. On her removal, subsequently, one Chaitali Shit was appointed as the teacher-in-charge. Such appointment was duly approved by the District Inspector of Schools. Thereafter, Chaitali Shit, the newly appointed teacher-in-charge, was authorized by the school to operate "all sorts of Bank accounts of the institution (school)", jointly with the administrator, that is, the

petitioner no.2, who is, co-incidentally, the husband of the said Chaitali Shit.

However, it is alleged that despite the petitioners having approached the concerned Bank, that is, the respondent no.1-Bank, the Punjab National Bank, the said Bank is not permitting such operation by Chaitali jointly with the petitioner no.2.

Learned counsel for the respondent-Bank submits that a bare representation was filed with the Bank without the necessary documents required for permitting such operation by Chaitali Shit along with petitioner no.2. On the query of court, learned counsel for the Bank, on instruction, submits that the said Chaitali Shit has to be present herself before the Bank authorities, along with her identification documents, appointment letter and necessary documents in that regard, as well as the documents pertaining to the removal of the erstwhile teacher-in-charge Sabita Das.

If such an approach is made, there is no impediment on the part of the Bank, upon verifying such documents, to permit the said Chaitali Shit to operate the school's account jointly with the petitioner no.2. In view of such fair submission by the Bank, WPA 7225 of 2023 is disposed of by directing the petitioners to

ensure that the said new teacher-in-charge Chaitali Shit, along with petitioner no.2, the administrator, shall present themselves before the respondent no.1-Bank with necessary documents pertaining to identification of Chaitali Shit, her appointment letter as Teacher-inCharge and other documents pertaining to her appointment, if any, and the documents relating to the removal of Sabita Das as teacher-in-charge.

As and when such approach is made during the regular office hours of the Bank, the respondent no.1Bank shall verify such documents expeditiously and, at the earliest thereafter, permit the said Chaitali Shit to operate the account of the petitioner no.1-School with the said Bank along with the petitioner no.2-administrator. It is made clear that the directions on the respondent no.1 shall also be binding on the respondent no.4, who is the Branch Manager of the Punjab National Bank, Bhimpore Branch.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
