Petitioner alleges that inspite of sustaining injury to the extent that he has been 80% physically disabled and is also facing impairment in hearing, yet he has not been given adequate protection by the police authorities, for which he is unable to stay at his home.

State has submitted a report which reflects that initially on the complaint filed by the petitioner Raninagar Police Station case no. 187/23 dated 09.04.2023 was registered for investigation and the investigating agency on conclusion of investigation submitted charge-sheet before the jurisdictional Court. Subsequently, again the petitioner complained and Raninagar Police Station case no.

92/25 dated 14.02.2025 was registered for investigation and on completion of investigation chargesheet was submitted before the jurisdictional Court.

On the contrary the respondent nos. 8 to 9 lodged a complaint pursuant to which Raninagar Police Station case no. 93/25 dated 15.02.2025 was registered for investigation and the investigation of the said case is still in progress.

On an assessment of the cases so registered it can be atleast stated that the police authorities have acted on information so received and whenever they found that a cognizable offence has been made out.

However, petitioner is aggrieved that he is unable to stay at his residence as the private respondents are bent upon to throw them away from his property and has been repeatedly attacking the petitioner and his family members.

Be that as it may, if the petitioner is facing inconveniences while staying at his residence, petitioner would apply before the jurisdictional Court which is already in seisin of all the criminal cases. Learned Magistrate would call for a Threat Perception Report and pass necessary directions upon the police authorities so that the Witness Protection Scheme, is implemented.

The police authorities would also ensure that there is no breach of the peace and/or tranquility and/or any untoward incidents resulting as the series of cases itself

reflect that the petitioner and the private respondents are in a strained relationship.

With the aforesaid observations WPA 7086 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
