10-09-2021 ct. no.34 debajyoti CRR 958 of 2012 In re: An application under Section 482 of the Code of Criminal Procedure read with Sections 397 and 401 of the Code of Criminal Procedure.

- And - In the matter of: Debdas Bhowmik ... Petitioner.

Ms. Sujata Das ... For the Petitioner.

Mr. Arijit Ganguly, Ms. Manisha Sharma ... For the State.

The present revisional application has not been admitted till date. Yet on the last occasion, when the matter appeared before this Court on the 25th August, 2021, a progress report/status report was called for. Mr. Arijit Ganguly, learned advocate, appearing for the State, has submitted a report of the Officer-in-Charge, Sutahata Police Station, Purba Medinipur. Let the report be taken on record.

The subject matter of the revisional application was for quashing of the charge-sheet in respect of the offence arising out of Sutahata PS Case No.69 of 2006 dated 22-08-2006 under Sections 304/323/34 of the Indian Penal Code. An accommodation has been sought for on behalf of the petitioner.

Having regard to the fact that the case was initiated in the year 2006 and till date, only adjournments have been sought for in this revisional application, I am of the view that the prayer so advanced is to be rejected.

Having gone through the materials in the report as well as the records of the case, I am of the view that the trial of the case should progress. Accordingly, CRR 958 of 2012 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, stands vacated. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J. )
