In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

This revisional application has been filed in respect of C.R. Case No. 536 of 2010 under Sections 103/104/107 of Trade Mark Act, 1999 including the orders dated 27.08.2010 and 09.09.2010 passed by learned Additional Chief Judicial Magistrate, Durgapur, Burdwan.

Records of the case reflect that at the stage of admission of the revisional application on 19.04.2012, no interim order was passed. I have perused the contentions advanced by the petitioner and the nature of allegation. Having regard to the stage at which the petitioner approached this Court and the fact that almost nine years have passed in the meantime and there is no progress report submitted by any of the parties to the case, I do not think that it would be fit and proper to keep the revisional application pending before this Court as the parties are not interested to pursue with the litigation. Accordingly, the revisional application being CRR 959 of 2012 is dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
