1. Learned counsel appearing on behalf of the petitioners submits as follows. There was an existing civil dispute between the private parties. An altercation took place between them which resulted in injuries on both sides. One of the associates of the petitioners received a fracture injury. There are case and counter case.

2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statements of the victim and the local eye-witnesses and also on the injury report, which, however, shows shoulder dislocation. The petitioners were allegedly assaulted by seven persons including the present petitioners.

3. Considering the above, the other materials available in the case diary and the fact that there are case and the counter case and injuries inflicted on both sides, I do not think that custodial interrogation of the petitioners is

required in this case and I am inclined to grant anticipatory bail to the petitioners. However, the movement of some of the petitioners needs to be remain restricted for a limited period.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner nos. 1, 3 and 5 shall meet the Investigating Officer once a week till submission of report in final form. The petitioner nos. 1, 3 and 5 shall stay outside the jurisdiction of Taherpur Police Station for a period of three months except for meeting the I.O or attending the jurisdictional Court.

5. Accordingly, the application for anticipatory bail is allowed.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
