In the matter of : An application under Section 407 read with Section 482 of the Code of Criminal Procedure. The present revisional application has been preferred for transferring of Complaint Case No.328 of 2011 from the court of the learned Judicial Magistrate, 1st Court, Sealdash, South 24 Parganas to any court within the jurisdiction of the learned District & Sessions Judge, Malda.

Records reflect that the present application first appeared on 5.6.2012, 19.6.2012 and 7.8.2012 when none appeared to represent the petitioner to present the case. Today, when the matter has been taken up, none appears for the petitioner to apprise this court regarding the present stage of the proceedings after nine years of filing. Having regard to the aforesaid facts, I am of the view that at this belated stage there is no scope for interference. However, the petitioner will be at liberty to file afresh if the

circumstance so warrants. For the present, CRR No.965 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order so passed, if any, is hereby vacated. Department is directed to communicate this order to the learned court below within a period of seven days from date.
