The State of West Bengal (S. Banerjee) The present revisional application has been preferred challenging the continuation of Sankrail Police Station Case No. 1230 of 2020 dated 27.12.2020.

Records reflect that charge-sheet was submitted by the investigating agency on conclusion of investigation under Section 407 of the Indian Penal Code. The annexures to the revisional application do not reflect that the copy under Section 207 Cr.P.C. were either available or were not enclosed.

The petitioner would be at liberty to canvas the points at the stage of consideration of charges before the learned Trial Court. If an application in the nature of Section 239/227 Cr.P.C. is preferred before the learned Magistrate in seisin of the matter, the same would be considered in accordance with law without being influenced by any observation made by this court. With the aforesaid observation, CRR 1078 of 2023 is disposed of.
