1. Compliance report as called for has been filed by the Certificate Officer, Howrah, the alleged contemnor. It appears that warrant has been executed and the contemnors are in custody.

2. Considering the said facts, the Certificate Officer is directed to proceed to realize the amount of gratuity as directed in accordance with law as per the provisions of the Public Demand Recovery Act and the said proceeding be concluded preferably within 60 days from the date of this order. It appears that the alleged

contemnor/ the Certificate Officer is proceeding in accordance with law, though there has been some time constraints. As such prima facie no case of contempt is made out.

3. The contempt application is accordingly disposed of with a direction that the Certificate Officer shall make all endeavour to ensure that the petitioner gets his gratuity as directed by the Controlling Authority and the Appellate Authority and if necessary, considering the financial status of the respondent company.

4. The Certificate Officer shall be at liberty to grant payment of the said amount of gratuity by way of installments on a prayer being made by the company.
