Ghosh ... for the petitioners The revisional application has been preferred against the order dated 19.1.2024, wherein the ld. Metropolitan Magistrate, 20th Court, Calcutta refused to adjourn the prayer of the accused persons for the purpose of stretching further dates in respect of the examination of the defence witness.

The reasons so assigned by the Ld. Magistrate was the period of pendency of the litigation, which is a complaint case of the year 2015.

Having considered the reasons so assigned by the ld. Metropolitan Magistrate, 20th Court, Calcutta, I am of the view that the period which was granted for adducing defence witness is sufficient.

However, the petitioner submits that he will take two dates for closing the defence evidence.

In view of the submissions so advanced, I direct that the petitioner would deposit an amount of Rs. 1 lakh before

the ld. Metropolitan Magistrate, 20th Court, Calcutta prior to 9.4.2024.

If such amount is deposited, the ld. Magistrate would fix two dates within a span of fortnight so that the defence evidence is closed and, thereafter, fix dates for final arguments of the case.

The final argument be carried on day to day basis till it is concluded.

The ld. Magistrate would pronounce its verdict by 31st of May, 2024.

In case, the amount is not deposited, the ld. Magistrate will proceed with the argument of the case in connection with CS Case NO. 51447 of 2015.

With the aforesaid observations, CRR 1143 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
