The grievance of the petitioner is that in spite of the earlier directions passed on 4th November, 2022 in CRR 1290 of 2021 till date the charges have not been framed and the learned Magistrate on 19th January, 2024 has fixed a date on 28th November, 2024 for consideration of charges. Having regard to the grievance so expressed that after more than 10 months the date has been fixed for consideration of charges, I direct the learned trial court to overcome the stage of consideration of charges on 28th November, 2024 or within a fortnight thereafter.
If after consideration of charges, the learned trial court is of the opinion that the trial of the case should proceed in that case the learned trial court would fix at least one date in every sixty days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties and the conducting advocates representing the respective parties would participate in the trial in spite of any resolution of the local Bar. The Public Prosecutor appearing in the case would produce the materials,
documents and exhibits on the dates fixed for examination of the witnesses concerned.
All efforts be taken by the learned trial court to conclude the trial at the earliest.
So far as the timeline which has been stated above, the learned trial court will not extend or stretch the timeline and if required will resort to harsher process of law for absence of any accused or non-cooperation of any accused. With the aforesaid observations, the revisional application being CRR 1126 of 2024 is disposed of.
